Citizens Defending Freedom Applauds States on Fighting Biden Administration's Unlawful Title IX Changes

TEXAS - Citizens Defending Freedom (CDF) commends all the states who took historic action to protect women’s rights in schools against the Biden Administration’s unilateral and unlawful changes to Title IX.


Yesterday, Texas, Florida, Georgia, Alabama, South Carolina, Mississippi, Louisiana, Montana, and Idaho all filed lawsuits to stop this action.


The Biden Administration moved to change the text of Title IX without congressional authorization by simply publishing a rewrite of the landmark civil rights statute to the Federal Register. This move jeopardizes the constitutional rights and safety of women across the nation. The Biden Administration's attempt to redefine "sex" under Title IX to include self-professed "gender identity" poses a direct threat to the protections Title IX affords women in educational settings.


Title IX, a cornerstone civil rights law, was designed to prohibit discrimination on the basis of sex in educational institutions that receive federal funding. However, the Department of Education, under the Biden Administration, has overstepped its authority by mandating compliance with radical gender ideology, thereby undermining the original intent of the law. By expanding the definition of "sex" to include "gender identity," the administration is compelling schools to accommodate individuals who identify as transgender, potentially endangering the safety and privacy of female students.


Over the past month, CDF has encouraged citizens to contact their Attorneys General to urge legal action to stop this new rule. In Texas, Tarrant County CDF Executive Director Rosalie Escobedo was able to speak to Attorney General Ken Paxton about the matter last week. This week, Paxton was among the first in the country to announce a lawsuit.


“Once again, I’m suing the Biden Administration for unlawfully using Title IX to mandate Radical Gender ideology, violating the constitution, and putting women at Risk. Texas will not allow Joe Biden to rewrite Title IX at a whim, destroying legal protections for women in furtherance of his radical obsession with gender ideology.” said Paxton.


CDF extends its sincere appreciation to Attorney General Paxton and the many other states who took legal action for their unwavering commitment to protecting women's rights.


Since 2022, CDF has mobilized numerous volunteers to advocate for action against the Biden Administration's Title IX changes. This included a meeting last month between the CDF Legal Team and representatives from the Biden Administration. Last year, CDF launched a Title IX Toolkit for parents to use to educate their local school board about Biden’s Title IX proposal. CDF has also been working to encourage people to comment on the proposed changes, contributing to roughly 400,000 public comments received by the Department of Education.


In Florida, the CDF Legal team sent a letter to Governor Ron DeSantis and other state officials as a show of support for their efforts to restore Title IX. Later that day, Florida Attorney General Ashley Moody joined Alabama, South Carolina, and Georgia in a lawsuit against the Biden Administration. Together, we must stand united in defense of women's rights and the rule of law.
