Washington, DC – Citizens Defending Freedom (CDF) applauds Congresswoman Mary Miller (R-IL) and 65 of her colleagues for introducing H.J.Res.165, under the Congressional Review Act (“CRA”) providing for congressional disapproval of the Biden administration's Title IX rule relating to "Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance.” On May 1, 2024, CDF initiated a call to action urging the public to contact their elected members of the U.S. House of Representatives and Senate to sponsor, co-sponsor, or support a Joint Resolution of Disapproval under the Congressional Review Act. That call has been answered, with members of Congress from Texas (8), Florida (8), and Georgia (5) leading all States in the number of co-sponsors for the CRA.
Congresswoman Miller released the following statement: "Joe Biden is undermining years of progress women have made in securing their rights under Title IX. For more than half a century, Title IX has protected women and girls, ensuring they have equal opportunities in education. However, the Biden Administration is putting our girls at risk by allowing men to access women and girls' bathrooms and locker rooms."
Congressman Guy Reschenthaler (R-PA), the House Republican Chief Deputy Whip and also a co-sponsor of the CRA told CDF, “Co-sponsoring the CRA is important to protect the safety and privacy of women and girls, but also to protect the integrity of Congress as an institution under the separation of powers delineated in our Constitution. Congressman Reschenthaler also added, “I also want to thank Citizens Defending Freedom for their important work raising awareness on Title IX in support of the United States Constitution.”
The new Title IX rules, which were not approved by Congress and are slated to take effect on August 1, 2024, redefine sex discrimination and sex-based harassment with the addition of gender identity as a protected class.
Congresswoman Anna Paulina Luna (R-FL) added, "I am proud to stand with Congresswoman Mary Miller on her joint resolution—Joe Biden's DOE does not get to decide what being a girl or woman means. As society drifts into the chaos of postmodernism, it is crucial that we, as legislators, stay firm and protect the rights of young women across America. They deserve to feel safe in their schools and confident in their sports."
The redefinition of Title IX absent of congressional approval is a violation of the separation of powers in the Constitution. "Despite the clear intent of Congress, the Department has now brazenly violated the separation of powers and limits of government set forth in our constitution, bypassing the legislative authority and congressional representatives elected by the people throughout the United States.” said Jonathan Hullihan, CDF General Counsel.
CDF urges citizens to contact their congressional representatives to support Congresswoman Miller's legislation to halt the Title IX changes via the Congressional Review Act.
