Local Evangelist Arrested While Ministering in Public; Charges Escalated

Macon, Georgia- Citizens Defending Freedom is representing a local evangelist who was arrested while ministering in a public space using a wireless portable public address system. Initially charged with disorderly conduct, the situation escalated during the evangelist's court appearance when the charges were increased to obstruction of an officer.

The arrest occurred on September 28, 2024, when Christopher Smith, a well-known evangelist in the community, was sharing a message of faith in a location he often visited in Macon, and across the street from the annual Macon Pride LGBT event. Using a portable sound system to ensure his message could reach those nearby, Smith says he was simply exercising his First Amendment rights to freedom of speech and religion.

Eyewitnesses report that the situation began to unfold after police approached evangelist Smith and asked him to cease his activities, citing noise complaints. According to onlookers, the pastor attempted to explain his intentions and respectfully engage with the officers but was ultimately taken into custody.

“This is about more than just me,” said Christopher Smith. “I was sharing a message of hope and encouragement in a peaceful manner. What happened feels like an infringement on my rights to speak freely and share my faith.”

The initial charge of disorderly conduct has since been elevated to obstruction of an officer, a development that Smith's legal team says is concerning. “We plan to defend Mr. Smith vigorously against this unconstitutional persecution by the state of Georgia,” said CDF attorney Catherine Bernard. “Mr. Smith was clearly exercising his rights within the First Amendment when the Bibb County Sheriff’s deputies arbitrarily decided to arrest him. American citizens are guaranteed the right to peaceably assemble. That right is non-negotiable, and we fully expect the criminal charges against Mr. Smith to be dismissed.”

Smith is set to appear in court again in February 2025. He remains hopeful for a resolution that reaffirms the principles of free speech and religious liberty.
